What is foreclosure?
Put into its simplest terms, a foreclosure occurs when a lender seizes
the home after a homeowner is unable to keep up with their payments; after
the home is seized, the lender can then evict the homeowner and sell the
home. Typically, one month of missing a payment is known as going into
default. After three to six months, the lender usually begins foreclosure.
Common Foreclosure Defense Strategies
Don't make the mistake of assuming that because you are facing foreclosure,
you are without options. Our firm can help by presenting certain actions
to a judge that may allow you to keep your home.
For example, we may be able to defend your home by arguing that:
- You are serving the military on active duty;
- Your original lender had unfair lending practices;
- The terms of your mortgage were "unconscionable";
- The foreclosing party is unable to prove they own the mortgage;
- There was a serious mistake made by the mortgage servicer; and/or
- The foreclosing party failed to follow proper state procedures.
Those, however, are not the only ways in which you can find relief from
foreclosure. Our New York law firm can also help you pursue the following
foreclosure mitigation options:
Deed in Lieu: By utilizing a deed in lieu of foreclosure, you would essentially transfer
all interest in the property to the lender to satisfy the loan. While
you may still lose your home, you can work to avoid the potential harrowing
credit damage that a foreclosure may cause.
Chapter 13: By filing for bankruptcy, you will immediately get to enjoy the benefit
of an automatic stay, which will put a halt to all collection attempts
and foreclosure proceedings. Chapter 13 may also allow you to reorganize
your debts and get caught up on your mortgage.
Loan Modification: In some cases, you may be able to negotiate a permanent modification to
the terms of your mortgage loan. This may include options to let you refinance
the home, pay a lower interest rate, or even let you extend the length
of your loan or skip a few payments.
Short Sale: During a short sale, a home would be sold for less than what is actually
owed to the lender with that money going to satisfy the debt. Again, this
option would still result in you losing your home, but you would be able
to avoid the credit damaging effects of a foreclosure.
